We reserve the right to restrict or terminate access to the Website where reasonably necessary to protect Therapies Magazine, our users or third parties.
3. EDITORIAL AND INFORMATIONAL CONTENT
Content published by Therapies Magazine is provided for general editorial, educational and informational purposes.
Articles, interviews, podcasts, guides and other content may discuss mental health, psychological wellbeing, healthcare, complementary therapies, nutrition, relationships, lifestyle and other health-related subjects. Such content is not a substitute for individual medical, psychological, psychiatric, therapeutic, legal or other professional advice, diagnosis or treatment.
Reading Therapies Magazine, listening to a podcast, attending an editorial event or using the Website does not create a therapist-client, doctor-patient or other professional relationship with Therapies Magazine, its editors, contributors, interviewees or Professional Directory members. Readers should seek appropriately qualified professional assistance where necessary. In an emergency or where urgent professional assistance is required, users should contact the appropriate local emergency or professional services.
4. EDITORIAL INDEPENDENCE
Therapies Magazine determines its editorial content independently. The publication of an article, interview, profile, advertisement, sponsored feature, Professional Directory listing or other material does not necessarily constitute an endorsement by Therapies Magazine of the views, products, treatments, services, professionals or organisations described. Opinions expressed by contributors, interviewees, guests or other third parties are their own unless expressly stated otherwise. Therapies Magazine may edit editorial contributions for grammar, length, clarity, formatting, style and publication requirements while seeking to preserve their substantive meaning.
PART II — INTELLECTUAL PROPERTY
5. THERAPIES MAGAZINE CONTENT
Unless otherwise stated, the Website and Therapies Magazine publications, including their design, branding, logos, articles, photographs, graphics, layouts, audio, video, downloadable materials and other original content, are owned by or licensed to Therapies Magazine and are protected by applicable intellectual property laws. Content may be accessed for personal and non-commercial use. Without prior written permission, you may not reproduce, republish, distribute, sell, license, commercially exploit, substantially copy, modify or create unauthorised derivative works from Therapies Magazine content. Nothing in these Terms transfers ownership of Therapies Magazine intellectual property to you.
6. SHARING OUR CONTENT
You may share links to publicly available Website pages through ordinary social media, email or other lawful means. You may not reproduce entire articles, magazine editions, paid digital publications, courses, ebooks or other protected materials merely because you provide attribution or a link to Therapies Magazine. Brief quotations may be used where permitted by applicable copyright law and with appropriate attribution.
PART III — MAGAZINE PURCHASES & SUBSCRIPTIONS
7. PRINT AND DIGITAL EDITIONS
Therapies Magazine may offer:
-
Individual digital issues;
-
Individual printed issues;
-
Digital subscriptions;
-
Print subscriptions;
-
Combined print and digital subscriptions;
-
Special issues;
-
Special editions; and
-
Other publication formats.
The exact contents, price, format, frequency and benefits applicable to a purchase or subscription are those displayed or communicated at the time of purchase.
8. PUBLICATION SCHEDULE
Therapies Magazine may publish according to an announced editorial schedule. Publication dates are estimates unless expressly stated otherwise. Editorial, production, printing, distribution or circumstances beyond our reasonable control may require a publication date to be changed. A reasonable alteration to a publication date does not itself entitle a subscriber to compensation, provided that the subscription purchased is substantially fulfilled. Nothing in these Terms affects mandatory consumer rights where a contractual obligation is not fulfilled.
9. DIGITAL EDITIONS
Digital editions may be supplied through the Website or through an external publication, fulfilment or distribution platform. Access may require a valid email address, account or third-party platform. Digital publications are licensed for the purchaser's personal use unless otherwise expressly agreed.
Purchasers must not:
-
Redistribute digital editions;
-
Upload them to public file-sharing services;
-
Resell access;
-
Share paid access credentials systematically;
-
Reproduce substantial portions for commercial purposes; or
-
Circumvent access or technological restrictions.
10. PRINT EDITIONS AND DELIVERY
Where Therapies Magazine sells a printed publication directly, the purchaser is responsible for providing a complete and accurate delivery address. Estimated delivery times may vary according to destination, printing arrangements, postal services and fulfilment providers. Where fulfilment or purchase takes place directly through an independent third-party platform, that provider's delivery and fulfilment terms may also apply. If a directly purchased order is materially delayed, damaged or not received, please contact us so that the matter can be investigated. Nothing in this section limits statutory rights concerning delivery or conformity of goods.
11. SUBSCRIPTIONS
The duration, price, included editions and other benefits of a subscription are those stated at the time of purchase. Unless automatic renewal is expressly disclosed and agreed to during purchase, a subscription does not automatically renew merely because a previous subscription has expired. Where automatic renewal is offered, the renewal conditions, frequency and applicable price will be disclosed before the subscription is concluded. We may contact subscribers with operational information necessary to administer an active subscription.
PART IV — PROFESSIONAL DIRECTORY
12. PROFESSIONAL DIRECTORY
Therapies Magazine operates a curated Professional Directory for therapists, practitioners, coaches and other eligible wellbeing professionals.
The Professional Directory is intended to provide professional visibility and help readers discover professionals.
A Professional Directory listing is not a certification, accreditation, clinical recommendation or guarantee by Therapies Magazine.
Readers remain responsible for deciding whether a particular professional is suitable for their individual needs.
13. DIRECTORY MEMBERSHIP OPTIONS
Therapies Magazine may offer different Professional Directory membership options, including:
Online Directory
Professional visibility through the Therapies Magazine Online Directory for the applicable membership period, together with the features and benefits described on the Website at the time of purchase.
Magazine Directory
Professional visibility in eligible issues of Therapies Magazine published during the applicable membership period, including the relevant digital and print editions, together with the features and benefits described on the Website at the time of purchase.
Online + Magazine Directory
Combined professional visibility through both the Therapies Magazine Online Directory and eligible magazine editions published during the applicable membership period, together with the features and benefits described on the Website at the time of purchase.
The current price, membership duration, features and benefits applicable to each Professional Directory membership option are those displayed on the Website or otherwise expressly communicated to the applicant before purchase.
The membership option selected and the information provided at the time of purchase form part of the applicable contract.
Therapies Magazine may change its prices, membership options, features or benefits from time to time for future purchases and renewals.
Any such change will not retrospectively alter the price or material benefits of an existing paid membership during its current membership period, except where a change is required by law or is otherwise permitted under these Terms and applicable law.
14. MEMBERSHIP PERIOD
The duration of each Professional Directory membership is stated on the Website or otherwise communicated to the applicant before purchase.
The applicable membership period begins on the commencement date confirmed by Therapies Magazine.
Unless expressly stated otherwise in the relevant membership offer, the number of magazine issues published during a membership period is not guaranteed.
Magazine Directory membership provides inclusion in eligible issues published during the active membership period, subject to editorial and production deadlines.
Expiration of a membership ends the member's entitlement to future publication or continued online visibility, as applicable to the membership selected.
Content already published in a printed or digital magazine edition may remain part of that edition and Therapies Magazine's publication archives after the membership has expired.
15. MAGAZINE DIRECTORY DEADLINES
Magazine production requires editorial and printing deadlines.
If a membership begins after the production deadline for an upcoming issue, inclusion may begin with the next eligible issue.
A member is not entitled to inclusion in an edition whose editorial or production deadline had already passed before the member's profile was approved and the necessary materials were received.
Therapies Magazine will make reasonable efforts to include eligible Magazine Directory members in the issues covered by their active membership.
16. DIRECTORY APPLICATION AND APPROVAL
Submission of a Professional Directory application does not guarantee acceptance.
Therapies Magazine may review applications to determine whether a professional or practice is appropriate for the Professional Directory.
We may request information reasonably necessary to verify professional identity, qualifications, professional status or information submitted for publication.
Therapies Magazine may refuse an application where there are reasonable concerns regarding eligibility, accuracy, legality, professional status, misleading information, reputation, safety or suitability for the Professional Directory.
Where an application is declined before a paid membership has commenced, any payment collected specifically for that membership will be refunded where applicable.
17. DIRECTORY MEMBER RESPONSIBILITIES
Professional Directory members are responsible for ensuring that information supplied to Therapies Magazine is accurate, current and lawful.
By submitting a listing, you confirm that:
-
You are entitled to use the professional title you provide;
-
You hold any licences, registrations, qualifications or authorisations legally required for the services you advertise in the jurisdictions in which you practise;
-
Your descriptions of qualifications and experience are accurate;
-
Your professional claims are not misleading;
-
You have permission to provide all photographs, logos, text and other materials submitted;
-
Your listing complies with applicable professional, advertising and consumer protection requirements; and
-
You will inform Therapies Magazine of material changes affecting the accuracy of your listing.
18. DIRECTORY CONTENT LICENCE
You retain ownership of materials that you submit to Therapies Magazine.
By submitting photographs, logos, biographies, descriptions, quotations or other materials for your Professional Directory profile, you grant Therapies Magazine a non-exclusive, worldwide, royalty-free licence to reproduce, format, edit for presentation, publish, display and promote those materials in connection with your Professional Directory membership.
This includes publication on the Website and, where included in your membership, in digital and printed editions of Therapies Magazine.
The licence continues for as long as reasonably necessary to administer and promote the relevant Professional Directory membership.
Where materials have been incorporated into a magazine edition, publication archive, promotional record or other material produced during the active membership period, Therapies Magazine may continue to retain, display and archive that historical material after the membership ends.
This includes previously published digital editions, printed editions, archived Website content and reasonable promotional records relating to those publications.
This licence does not transfer ownership of your materials to Therapies Magazine and does not permit unrelated commercial use of your materials outside the purposes described above.
19. PROFILE CHANGES
Professional Directory members may request reasonable corrections to their professional information.
Changes affecting a printed edition cannot normally be made after the relevant editorial or production deadline.
Content already printed or distributed cannot be recalled or altered retrospectively.
Online profile changes may require a reasonable processing period.
20. SUSPENSION OR REMOVAL FROM THE DIRECTORY
Therapies Magazine may suspend, refuse to publish or remove a Professional Directory listing where reasonably necessary, including where:
-
Information is materially false or misleading;
-
Required professional authorisation has expired or cannot reasonably be verified;
-
The listing infringes third-party rights;
-
The professional uses the Professional Directory unlawfully;
-
Continued publication could reasonably expose readers or Therapies Magazine to harm or legal risk; or
-
The member materially breaches these Terms.
Where reasonably appropriate, we may contact the member before removal and provide an opportunity to clarify or correct the issue.
Nothing in this section gives Therapies Magazine responsibility for regulating or supervising the professional practice of Professional Directory members.
21. NO GUARANTEE OF DIRECTORY RESULTS
Professional Directory membership purchases professional visibility, not commercial results.
Therapies Magazine does not guarantee:
-
A particular number of profile views;
-
Enquiries;
-
Referrals;
-
Clients;
-
Appointments;
-
Revenue;
-
Search engine ranking; or
-
Any particular professional or commercial outcome.

Digital products are supplied for the purchaser's personal use unless expressly stated otherwise.
You may not reproduce, distribute, resell, sublicense, upload publicly, share access to, commercially exploit or make digital content available to third parties without permission.
Where access is provided for a defined period, the applicable access period will be stated before purchase.
We do not guarantee that a particular digital product will remain available indefinitely unless lifetime or permanent access is expressly included in the offer.
24. ONLINE COURSES
Where Therapies Magazine directly provides an online course, the course description will specify the principal content and any applicable access period.
Purchasing a course does not grant permission to copy, teach, reproduce, resell or redistribute course materials.
Unless expressly stated otherwise, completion of a Therapies Magazine educational course does not confer a regulated professional qualification, licence, accreditation or authorisation to practise.
Educational content does not replace professional training, supervision or legally required qualifications.
25. THIRD-PARTY PRODUCTS AND SERVICES
The Website may display or link to products, courses, services or resources supplied by independent third parties.
Where the user is redirected to another website or provider to complete a purchase, the contract is concluded with that provider and is governed by that provider's terms and conditions, privacy policy, payment rules, refund policy and other applicable conditions.
This includes products or services displayed or referenced on Therapies Magazine but purchased directly through Malaga Therapy or another independent provider.
Therapies Magazine is not the seller merely because a third-party product or service is mentioned, displayed or linked from the Website.
PART VI — EVENTS, BRUNCHES & IN-PERSON EXPERIENCES
26. EVENTS
These Terms apply to events organised directly by Therapies Magazine, including the Therapies Magazine Brunch, as well as future professional, editorial, networking, community or other events and experiences.
Event-specific information displayed or communicated when booking, including the date, venue, programme, price and inclusions, forms part of the booking conditions.
27. EVENT REGISTRATION
A place is not guaranteed until any required registration and payment have been successfully completed.
Tickets or registrations may be subject to capacity limits.
Where tickets are sold directly by an independent ticketing platform, that platform's terms may additionally apply to the transaction.
28. EVENT CHANGES AND CANCELLATION
Therapies Magazine may make reasonable changes to:
-
Speakers;
-
Contributors;
-
Programme order;
-
Activities;
-
Timings;
-
Venue within a reasonable geographical area; or
-
Other operational aspects of an event.
Such changes do not automatically constitute cancellation of the event.
If an event is cancelled by Therapies Magazine and no suitable replacement or rescheduled event is offered, purchasers who bought directly from Therapies Magazine will be entitled to the appropriate refund of the event ticket price.
Where tickets were purchased from an independent ticketing provider, refunds may be processed through that provider in accordance with the applicable booking conditions.
29. EVENT ATTENDEE CONDUCT
Attendees must behave lawfully and respectfully toward other attendees, speakers, staff and venue personnel.
Therapies Magazine may refuse admission or require a participant to leave where their behaviour is abusive, threatening, discriminatory, dangerous, seriously disruptive or unlawful.
No refund is required where removal results from the attendee's serious misconduct, subject to applicable law.
30. PHOTOGRAPHY AND RECORDING AT EVENTS
Photography, audio or video recording may take place at Therapies Magazine events.
Where recordings are intended for editorial, documentary or promotional use, appropriate information will be provided during registration, at the event or by other appropriate means where required.
Where individual consent is legally required for a particular use, Therapies Magazine will seek that consent.
Further information about how personal data is processed is available in our Privacy Policy.
PART VII — ADVERTISING, SPONSORSHIP & SPONSORED CONTENT
31. ADVERTISING AND COMMERCIAL OPPORTUNITIES
Therapies Magazine may offer commercial opportunities including:
-
Print advertising;
-
Digital advertising;
-
Sponsored features;
-
Sponsored content;
-
Podcast sponsorship;
-
Event sponsorship;
-
Brand partnerships; and
-
Other promotional placements or collaborations.
Specific deliverables, prices, formats, publication dates and other campaign conditions may be agreed separately through a proposal, quotation, invoice, booking confirmation, insertion order, email confirmation or other written agreement.
Where a specific written agreement conflicts with these general Terms regarding a particular campaign, the specifically agreed terms will prevail for that campaign.
32. ADVERTISER AND SPONSOR RESPONSIBILITIES
Advertisers and sponsors are responsible for ensuring that materials and claims supplied to Therapies Magazine:
-
Are accurate and not misleading;
-
Comply with applicable advertising and consumer protection law;
-
Do not infringe intellectual property, privacy or other third-party rights;
-
Do not contain unlawful or defamatory material;
-
Have all necessary permissions, licences and approvals; and
-
Comply with applicable rules governing regulated products, health claims or professional services.
The advertiser or sponsor grants Therapies Magazine the limited rights necessary to reproduce, format and publish the supplied materials for the agreed campaign.
33. RIGHT TO REFUSE ADVERTISING OR SPONSORED CONTENT
Therapies Magazine may refuse, request amendments to or withdraw advertising or sponsored material where reasonably necessary for legal, ethical, editorial, reputational or technical reasons.
Payment for advertising or sponsorship does not guarantee or imply editorial endorsement by Therapies Magazine.
Advertising and sponsored content may be identified as advertising, sponsored, partnership content or by another appropriate disclosure.
34. ADVERTISING DEADLINES
Advertisers and sponsors are responsible for providing required materials by agreed deadlines. Late delivery may result in postponement, modification or loss of the intended placement where publication can no longer reasonably be accommodated. Any specific cancellation, replacement or rescheduling conditions may also be stated in the relevant proposal, quotation or booking confirmation.
35. NO GUARANTEE OF ADVERTISING RESULTS
Unless expressly agreed in writing as a specific guaranteed metric, Therapies Magazine does not guarantee:
-
Sales;
-
Leads;
-
Enquiries;
-
Clicks;
-
Conversions;
-
Audience response;
-
Revenue;
-
Search engine ranking; or
-
Other commercial results from advertising, sponsorship or sponsored content.
PART VIII — CONTRIBUTORS, INTERVIEWS & PODCASTS
36. CONTRIBUTOR MATERIALS
Contributors retain ownership of original materials they create unless a separate written agreement provides otherwise.
By voluntarily submitting an article, interview response, photograph, professional biography, audio, video, quotation or other material for agreed publication, the contributor grants Therapies Magazine a non-exclusive, worldwide, royalty-free licence to edit, format, reproduce, publish, distribute, archive and promote the relevant contribution in connection with Therapies Magazine.
This licence includes the right to use reasonable excerpts from the contribution, the contributor's name, professional title, approved photographs, biography and quotations for the purpose of promoting the relevant article, interview, podcast, magazine edition, event or other editorial feature through Therapies Magazine's Website, newsletters, social media channels and other owned promotional channels.
Therapies Magazine will not intentionally use contributor materials in a manner that materially misrepresents the contributor or the substance of the contribution.
The contributor confirms that they have the necessary rights and permissions to submit all materials provided for publication.
Where material has already been incorporated into a published magazine edition, podcast episode, Website article, archive or other published editorial content, Therapies Magazine may continue to retain and make that historical publication available after the original publication date, subject to applicable law and any separate written agreement.
37. EDITORIAL EDITING
Therapies Magazine may edit submissions for:
-
Grammar;
-
Spelling;
-
Length;
-
Clarity;
-
House style;
-
Layout;
-
Headings;
-
Formatting; and
-
Publication requirements.
Material changes affecting the substantive meaning of an interviewee's or contributor's statements should not intentionally misrepresent the contributor.
38. PUBLICATION IS NOT GUARANTEED
Submission, interview participation or acceptance of materials does not necessarily guarantee publication unless publication has been expressly agreed.
Editorial schedules may change.
Therapies Magazine may decide not to publish material where reasonably necessary for editorial, legal, ethical, factual or production reasons.
39. CONTRIBUTOR WARRANTIES
A contributor submitting original material confirms, to the best of their knowledge, that:
-
They are entitled to submit it;
-
It does not knowingly infringe third-party intellectual property rights;
-
Material presented as factual is not knowingly false;
-
Necessary permissions have been obtained for third-party photographs or materials; and
-
The submission does not contain unlawful or defamatory material.
PART IX — PRICES, PAYMENTS & ORDERS
40. PRICES
The prices applicable to Therapies Magazine products, publications, subscriptions, memberships, events, advertising opportunities and other paid services are those displayed on the Website, relevant purchasing platform, booking page, proposal, quotation or other applicable sales communication at the time of purchase.
Prices may vary according to the product, format, subscription, membership, event, advertising package or service selected.
Where applicable, taxes, delivery charges or other mandatory charges will be displayed or communicated before the order is completed in accordance with applicable law.
Therapies Magazine may change its prices at any time for future purchases and renewals.
A subsequent price change will not retrospectively alter the price of an order, booking, membership or other purchase that has already been validly concluded, except where permitted or required by applicable law.
In the event of an obvious pricing or technical error, Therapies Magazine may take reasonable steps to correct the error in accordance with applicable law.
41. PAYMENT
Payment may be processed by independent payment providers.
By submitting payment information, you confirm that you are authorised to use the selected payment method.
Therapies Magazine does not guarantee acceptance of a transaction by a payment provider or financial institution.
Where a transaction is processed by an independent platform, additional payment terms imposed by that platform may apply.
42. ORDER CONFIRMATION
An order, subscription, membership or registration may be confirmed electronically.
Where applicable, confirmation may include information regarding:
-
The product or service purchased;
-
Price;
-
Access or delivery;
-
Subscription or membership period;
-
Event details;
-
Digital content access; and
-
Relevant cancellation or withdrawal information.
The information communicated before purchase and the applicable order confirmation form part of the relevant contract.
PART X — CANCELLATIONS, REFUNDS & CONSUMER WITHDRAWAL RIGHTS
43. GENERAL PRINCIPLE
Refund, cancellation and withdrawal rights depend on the nature of the product or service purchased, the purchaser's legal status and applicable law.
Consumers purchasing at a distance may have a statutory withdrawal period, subject to applicable exceptions and conditions.
Nothing in these Terms excludes, restricts or removes mandatory consumer rights.
44. PHYSICAL PRODUCTS
Where a statutory right of withdrawal applies, an eligible consumer may withdraw from an online purchase of physical goods within the legally applicable period.
The consumer must communicate the decision to withdraw within the applicable period.
Goods should be returned in accordance with applicable law and the relevant return instructions.
The consumer may be responsible for direct return costs where this has been properly disclosed and is permitted by law.
Statutory exceptions may apply to certain categories of goods, including personalised or made-to-order products where applicable.
Nothing in this section affects statutory rights relating to defective, damaged or non-conforming goods.
45. MAGAZINES AND SUBSCRIPTIONS
Different statutory rules may apply to the purchase of individual newspapers, periodicals or magazines and to subscription contracts for such publications.
Where a statutory withdrawal right applies to a magazine subscription or other publication purchase, Therapies Magazine will respect that right.
Nothing in these Terms removes mandatory rights relating to defective, damaged, missing or non-conforming publications.
46. DIGITAL CONTENT AND IMMEDIATE ACCESS
Different rules may apply to digital content that is not supplied on a tangible medium, including ebooks, downloads, digital publications and other immediately accessible digital materials.
Where permitted by applicable law, the statutory right of withdrawal may be lost once supply of digital content begins if the required legal conditions have been satisfied.
Where required, before immediate supply begins, the consumer may be asked to:
-
Give prior express consent for supply to begin during the applicable withdrawal period; and
-
Acknowledge that beginning supply will result in the loss of the statutory right of withdrawal.
Where the applicable legal requirements for loss of the withdrawal right have not been satisfied, these Terms do not remove a statutory withdrawal right that would otherwise apply.
47. ONLINE COURSES AND DIGITAL SERVICES
The legal treatment of an online course or digital service may depend on the nature and manner of supply.
Where a service begins during an applicable statutory withdrawal period at the consumer's express request, applicable rules concerning performance, withdrawal and any amount payable will apply.
Where a service has been fully performed and the statutory conditions for loss of the withdrawal right have been satisfied, the right of withdrawal may cease.
Therapies Magazine will not apply a contractual restriction on refunds or withdrawal where mandatory consumer legislation provides otherwise.
48. EVENTS AND DATE-SPECIFIC ACTIVITIES
Certain event, leisure or related service bookings for a specific date or period may be excluded from the statutory right of withdrawal under applicable consumer law.
Where such an exception applies to a Therapies Magazine event, the purchaser will not acquire a statutory withdrawal right merely because the booking was made online.
Any additional voluntary cancellation, transfer or refund policy applicable to a particular event may be stated in the event-specific booking conditions.
49. PROFESSIONAL DIRECTORY MEMBERSHIPS
Professional Directory memberships are professional visibility services.
Cancellation and withdrawal rights may depend on the purchaser's legal status, the circumstances of the purchase, whether performance has begun and applicable law.
Where a Professional Directory membership is purchased by a consumer and mandatory consumer withdrawal rights apply, those rights will be respected.
Where the member requests that performance begin during an applicable withdrawal period, any consequences for withdrawal will be handled in accordance with applicable law.
For memberships purchased in a professional or business capacity, statutory consumer withdrawal rights may not apply.
Once material has been incorporated into a printed or digital magazine edition, that edition may remain in circulation or in Therapies Magazine's historical archives notwithstanding subsequent cancellation or expiration of the membership.
50. REQUESTING CANCELLATION OR EXERCISING A WITHDRAWAL RIGHT
Where you are legally entitled to withdraw from a contract or where Therapies Magazine offers a voluntary cancellation right, you may contact:
Your communication should clearly identify the relevant order, subscription, membership or booking and state your decision to withdraw or cancel.
Where a statutory withdrawal right applies, no particular wording is required provided that the decision is clear and unequivocal.
Any refund legally due following a valid withdrawal or cancellation will be processed in accordance with applicable law.
PART XI — THIRD-PARTY SERVICES & LINKS
51. THIRD-PARTY PLATFORMS
Therapies Magazine may use or link to independent platforms for:
-
Payment;
-
Magazine fulfilment;
-
Printing;
-
Ticketing;
-
Podcasts;
-
Events;
-
E-commerce;
-
Courses;
-
Social media; or
-
Other services.
A link, reference or technical integration does not necessarily mean that Therapies Magazine controls that provider.
Where a transaction is concluded directly with a third party, that third party is responsible for performing its own contractual obligations.
52. EXTERNAL LINKS
The Website may contain links to websites that Therapies Magazine does not control.
We are not responsible for the availability, security, accuracy, privacy practices or content of independent third-party websites.
Users should review the applicable terms and policies before purchasing from or providing personal information to a third party.
PART XII — LIABILITY & DISCLAIMERS
53. PROFESSIONAL DIRECTORY DISCLAIMER
Therapies Magazine provides the Professional Directory as an informational and professional visibility service.
Although we may review information or request supporting documentation, Therapies Magazine does not assume responsibility for independently supervising the professional practice of Professional Directory members.
Users should make their own enquiries regarding a professional's qualifications, suitability, licensing and services where appropriate.
Any professional relationship is between the user and the professional concerned.
Therapies Magazine is not a party to that professional relationship.
54. HEALTH AND WELLBEING DISCLAIMER
Therapies Magazine does not provide individual medical diagnosis, psychological assessment or therapeutic treatment merely by publishing health, therapy or wellbeing content through the Website, magazine, podcast or other editorial channels.
Health and wellbeing information may evolve and may not apply to an individual's circumstances.
Users should not disregard appropriately qualified professional advice solely because of something read, heard or viewed through Therapies Magazine.
55. WEBSITE AND DIGITAL SERVICE AVAILABILITY
We aim to maintain the Website and digital services in good working order but do not guarantee uninterrupted or error-free availability.
Maintenance, security incidents, provider outages, technical failures or circumstances outside our reasonable control may temporarily affect access.
Where a paid service is materially affected, we will take reasonable steps consistent with applicable contractual and consumer obligations.
56. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Subject to mandatory law, Therapies Magazine is not responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was entered into.
For users acting in a professional or business capacity, Therapies Magazine will not be liable for loss of profits, business opportunities, anticipated savings, goodwill or other indirect commercial losses except where liability cannot legally be excluded.
Any limitation contained in these Terms remains subject to mandatory consumer protections.
57. USER RESPONSIBILITY
You are responsible for:
-
Providing accurate information;
-
Using products and services lawfully;
-
Protecting account credentials where applicable;
-
Reviewing product or service descriptions before purchasing;
-
Determining whether editorial information is appropriate for your circumstances; and
-
Obtaining qualified professional advice where appropriate.
PART XIII — GENERAL CONTRACT TERMS
58. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL
Therapies Magazine will not be responsible for delay or failure caused by events outside our reasonable control to the extent permitted by law. Such events may include major transport disruption, postal interruption, natural disasters, public health emergencies, government restrictions, widespread telecommunications failures, venue closure, industrial action affecting third parties or other comparable circumstances. Where such an event affects a paid service, we will take reasonable steps to minimise disruption and comply with applicable consumer law.
59. CHANGES TO PRODUCTS AND SERVICES
Therapies Magazine may develop, discontinue or modify products, Website features, membership options, event formats, advertising opportunities and other services. Changes will not retrospectively remove material benefits already purchased for an active paid period unless reasonably necessary and permitted by applicable law. Future purchases and renewals may be subject to updated prices, features and conditions disclosed before purchase.
60. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Website, services, business practices or applicable law. The “Last updated” date at the beginning of these Terms indicates when they were most recently revised. Changes will apply prospectively unless applicable law requires otherwise.
Where a material change affects an existing ongoing paid contract, appropriate notice will be provided where required.
61. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
62. NO WAIVER
If Therapies Magazine does not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.
63. TRANSFER OF RIGHTS
You may not transfer contractual rights or obligations under a personal subscription, membership, ticket, course or other service where the relevant offer is expressly personal or non-transferable, except where permitted by applicable law or agreed by Therapies Magazine. Therapies Magazine may use service providers and subcontractors to perform parts of its obligations. Any transfer of a contract by Therapies Magazine will be subject to applicable law and will not reduce mandatory consumer rights.
64. ENTIRE AGREEMENT
These Terms, together with any product-specific information, booking conditions, proposal, quotation, order confirmation or other conditions expressly incorporated into a transaction, form the agreement applicable to that transaction. The Privacy Policy governs how Therapies Magazine processes personal data. The Cookie Policy explains the use of cookies and similar technologies on the Website.
PART XIV — GOVERNING LAW & DISPUTES
65. GOVERNING LAW
These Terms are governed by the laws of Spain, subject to any mandatory consumer protections that apply under the law of a consumer's country of residence. Nothing in these Terms deprives a consumer of mandatory protections that cannot lawfully be excluded by contract.
66. DISPUTES
If a dispute arises, we encourage you to contact Therapies Magazine first so that we can attempt to resolve the matter directly. Email: hello@therapiesmagazine.com
Any dispute that cannot be resolved amicably will be subject to the competent courts determined under applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively in Málaga where mandatory consumer jurisdiction rules provide otherwise.
